What matters are the #defines and structs. It may be technically allowed to change in FreeBSD but I'd argue that doing so would be misguided since it's a explicit "let's have linux compatibility" interface. So I think it may be better to just ship the header regardless and deal with the fallout if it ever changes. Otherwise, we're just trying to solve a problem that may never occur in the first place.
