According to some interpretations of US law (Patriot Act for starters), any 
data held on or passing through equipment owned by a US company, no matter 
where it is physically located, is subject to US law and can be "demanded with 
menaces" by US authorities.  It's a shame they don't try to apply this to 
spammers.
