problems with motd

No idea off the top of my head -- my logins don't do this. Are you
sure it's not part of the shell startup?

This just toggles updates or the kernel version in /etc/motd by the
script /etc/rc.d/motd, it has nothing to do with whether /etc/motd is
displayed.
