I had no such problem on my RELENG_7 box.
pkg_info reports:
$ pkg_info | grep ImageMagick
ImageMagick-6.4.9.8 Image processing tools
$

In the past I had problems updating ImageMagick, too. Back then it did 
help to play around with some of the options. I don't know if that helps 
in your case.
