You can manually remove offending files in ports/lang/ruby18/files:
patch-lib_cgi.rb
patch-lib_ipaddr.rb
patch-lib_optparse.rb
patch-lib_resolv-replace.rb
patch-lib_resolv.rb
patch-lib_webrick_httputils.rb
