Patch Dummynet

Halo, 
I'm student whose doing final project about QoS.
I need Dummynet to set my bandwidth.
I've search on internet, i've got "20040323.diff"
patch.
But somehow it didn't work.
with error message :
# ipfw add pipe 1 ip from any to any
ipfw: getsockopt(IP_FW_ADD):Protocol not available
#

Could you tell me where i can get it ?
maybe from you :)
