I do not have this problem with my bfe NIC and it always worked here.

bfe0 at pci2:5:0:  class=0x020000 card=0x108217c0 chip=0x440114e4 rev=0x01 hdr=0x00
    vendor   = 'Broadcom Corporation'
    device   = 'BCM4401 10/100 Integrated Ethernet Controller'

So it is a different card but the same chip and revision.

The system is a FreeBSD 7.0-CURRENT with sources from last weekend.

I just applied your patch and it does still work for me, so if the patch works 
for you, we can both be happy :)
